These Terms of Use govern the use of the website published at keydesignart.com in Turkish and English. The website is an informational site that presents the services of Key Design&Art and lets visitors get in touch with us.
The site has no membership, user accounts, registration or sign-in for visitors, and no ordering, payment or subscription functionality. Please read these terms before using the site.

Scope and Acceptance
These terms apply to keydesignart.com only. By visiting the site, browsing its pages or using the contact form, you accept them. If you do not accept them, please do not use the site.
The site offers visitors no way to create an account or sign in. The administration panel login is intended solely for internal company use and is not open to visitors.
Products and services offered on separate domains — including our own product Keysletter — fall outside these terms and are governed by their own terms of use. Plan and billing rules relating to Keysletter do not apply to this site.

Purpose of the Site and Nature of Its Content
The service descriptions, reference and portfolio work and blog articles on this site are provided for promotional and informational purposes. No content on the site constitutes an offer or an undertaking, and no content forms a contract on its own. A project relationship is established only through a separate written agreement signed by the parties; the scope, duration, delivery terms and fee of the work are determined solely in that agreement.
Blog and guide content
Articles published on the blog are prepared for general information, based on the legislation, technology and market conditions in force on their publication date. They do not replace legal, financial or technical advice for a specific project, and their continued accuracy is not guaranteed. Please assess any topic against your own circumstances before acting on such content.
Reference and portfolio visuals
Client logos, brand names and project visuals shown on the site belong to their respective owners and are used solely to present completed work. Such use does not imply any claim of right over those brands.

Use of the Contact Form
The form on the contact page requires your Full Name, Email and Message; the Phone and Subject fields are optional. The footer of the other pages carries a shortened form consisting only of Full Name, Email and Message. On the contact page the footer form is hidden, so that two forms are never displayed on the same page. When using the form:
- The information you provide must be accurate, current and your own.
- You must not enter personal data belonging to third parties without their knowledge and consent.
- Please do not share special categories of personal data — such as health, belief or membership information — in the message field.
- The form may not be used to send advertising, bulk messages, harmful links or unlawful content, and may not be submitted through automated tools.
- The form is not a confidential or emergency channel; please do not send confidential information through it.
You are responsible for the lawfulness and accuracy of the content you send through the form. To prevent abuse, the form uses technical measures such as a honeypot field, token validation and rate limiting; attempts to circumvent these measures are prohibited. Your message is stored in our database and forwarded to our company e-mail address. Any reply we send is limited to responding to your own request; sending newsletters, campaigns or promotional messages to the same address would require your separate consent. By submitting the form you confirm that you have read these Terms of Use and our Privacy Policy.

Intellectual Property
The source code, interface design, page texts, blog articles, images, icons, illustrations and the structure created by the selection and arrangement of the content are protected under Law No. 5846 on Intellectual and Artistic Works. Unless stated otherwise, the rights in these elements belong to Key Design&Art.
You may view the site for personal, non-commercial purposes and quote from its content to a reasonable extent, provided you cite the source and link back. Any other reproduction, distribution, adaptation, commercial use or republication of all or a substantial part of the content requires our prior written permission.
The signs "Key Design&Art", "KeyDesignArt" and "Keysletter" and our logos are distinctive signs of our business and may not be used without permission. Linking directly to the site is permitted; presenting our content as part of your own site through framing, and using our logos without permission, are not.

Prohibited Uses
The following are prohibited when using the site:
- Bulk content retrieval, scraping or systematic copying of content by means of automated tools, bots or scripts;
- Bulk extraction of content for training artificial intelligence models or similar purposes;
- Circumventing or attempting to disable security measures such as rate limiting, token validation and the honeypot field;
- Unauthorised security scanning, penetration testing, load testing or any attempt to gain unauthorised access;
- Attempting to access the administration panel login without authorisation or using credentials without permission;
- Reverse engineering the source code;
- Impersonating another person or using misleading identity information;
- Conduct that overloads the system, disrupts the service or blocks other visitors' access;
- Distributing malicious software or transmitting unlawful content.
Search engine indexing bots that comply with the rules in the site's robots.txt file are exempt from these prohibitions. In addition to breaching these terms, the acts listed above may give rise to legal consequences under Law No. 5846 and under the unfair competition provisions of the Turkish Commercial Code No. 6102 (in particular Articles 54 and 55).

Personal Data and Cookies
Detailed information about the personal data processed through the contact form and the server logs kept for security purposes is available on our Privacy Policy and Data Protection Notice page. These Terms of Use are not a data protection notice.
Messages sent through the contact form are kept for no longer than two years. If your enquiry turns into a project, the data processed within that project is subject to the contractual relationship established and to the retention periods set out in the applicable legislation. Server logs kept for security purposes are retained for one year; they are used solely to prevent abuse, resolve errors and maintain the security of the system. You may exercise your rights concerning your personal data under Article 11 of Law No. 6698.
Cookies and external resources
Only strictly necessary cookies are used on the site. These cookies perform functions required for the site to work, such as maintaining session security and validating form submissions; they are not used to measure visitor behaviour or to build profiles. As the site uses no analytics, advertising or marketing cookies, no cookie preference window is displayed either.
The fonts used on the site are hosted on our own server; no request is sent to Google Fonts when you view the pages. Because the site is published from servers located in Türkiye, the data collected through the contact form and the server logs are held in Türkiye and are not currently transferred abroad.

Third-Party Links
The site may link to websites operated by others. Linked content is not adopted by us; the owners of those sites are responsible for their content, security and privacy practices. The presence of a link does not mean that we recommend the site or service in question. Once you follow a link to another site, that site's own terms of use and privacy practices apply.

Availability and Maintenance
We do not undertake that the site will be available without interruption or free of errors. Access may be temporarily suspended due to maintenance, updates, infrastructure changes or technical reasons beyond our control. We reserve the right to change the content, structure and features of the site, or to withdraw them, without prior notice.

Limitation of Liability
To the extent permitted by applicable law, we accept no liability for indirect damages arising from use of the site — such as loss of profit, loss of data and business interruption — nor for interruptions in access, for the currency of the content, or for damages arising from the content of third-party sites.
This limitation does not cover liability arising from our intent or gross negligence; mandatory provisions of Turkish law, in particular Article 115 of the Turkish Code of Obligations No. 6098, are reserved. Furthermore, our liability under service agreements signed with our clients cannot be limited by these terms; that relationship is governed by the provisions of the relevant agreement.

Notice of Infringement and Content Removal
If you believe that content on the site infringes your intellectual property rights, personal rights or other rights, you may notify us at info@keydesignart.com. Please state the address of the relevant page, the right you believe has been infringed and its basis, and your name and contact details. We will review your notice as soon as possible, remove or correct the content where we find the notice justified, and inform you of the outcome.

Changes to These Terms
We reserve the right to update these terms. Changes take effect on the date they are published on the site and apply only to use occurring after that date; they do not have retroactive effect. You can identify the version in force from the "Last updated" date at the end of this page.
If analytics measurement is introduced on the site in future, this text will be updated and that measurement will run only where consent is given through the Accept / Reject options in the cookie preference window.

Governing Law and Resolution of Disputes
These terms are governed by Turkish law. In disputes where the parties are merchants or public legal entities, the Istanbul Anadolu Courts and Enforcement Offices have jurisdiction. In all other cases, the general and special jurisdiction rules provided by law apply; the right of persons qualifying as consumers to apply to consumer arbitration committees and to the consumer court of their own place of residence is reserved.
In the event of any inconsistency between the Turkish and English versions of this text, the Turkish version prevails.
